If you are acting as an Attorney under a Lasting Power of Attorney or an Enduring Power of Attorney you may need to register the document. To do this you have to inform the donor plus specified people in writing. You then fill in a form to apply to the Court of Protection, to register the power.
Once an LPA or EPA has been registered then it cannot be revoked without the agreement of the Court.
An LPA can be registered at any time, and cannot be used without registration.
An existing EPA can be used without being registered, but registration is required when the donor is becoming (or has become) incapable of handling their own affairs.
Please contact us for specific advice should you need to undertake this process.
